More than 25 states award some financial aid for college students based on academic achievement, as opposed to need. Thirteen states, primarily in the South, award more than half of their financial aid based on merit.

Now that movement may be picking up steam.

Last year, with Georgia?s scholarship program facing financial distress, lawmakers decided to increase the academic requirements for scholarships. Administrators say the change will help keep the program solvent. But it also wound up funneling a greater portion of the remaining aid to higher-income students.

Georgia?whose Hope scholarship program is among the largest merit-based programs in the country?is at the forefront of a growing national debate over state-backed financial aid for college students. Should states direct aid to the highest-achieving students, regardless of income? Or should the money go to poorer students?

Proponents of merit, or some combination of merit and need, say focusing on achievement helps reduce a ?brain drain? of talented residents leaving home states, and rewards those who study hard and apply themselves.

Though the trend rarely gets much attention and is obscured by increases in federal grants to poor students, 27 states have created some sort of merit-aid program since Georgia launched its own in 1993.

Of those, 13 states based over half of their grant money on merit in 2010-2011, the latest year available. In Arkansas, Louisiana, Mississippi, South Dakota and Georgia, more than 85% of grants were merit-based.

Now, with funding for the scholarships falling behind steady hikes in college tuition and in the number of kids receiving them, lawmakers in Tennessee, South Carolina, New Mexico and other states are weighing some tough calls on how to distribute their grants.

For its part, Georgia rejected proposals by some lawmakers for an income cap and decided instead to require better grades and, for the first time, strong SAT or ACT test scores for full-tuition scholarships.

Toyota settlement will top $1 billion

Toyota Motor Corp. has agreed to pay as much as $1.4 billion to settle U.S. litigation claims that its vehicles suddenly and unintentionally accelerated, according to court filings made public Wednesday.

The company said the deal will resolve hundreds of lawsuits from Toyota owners who said the value of their cars and trucks plummeted after a series of recalls stemming from claims that Toyota vehicles accelerated unintentionally.

Steve Berman, a lawyer representing Toyota owners, said the settlement is the largest in U.S. history involving automobile defects.

"We kept fighting and fighting and we secured what we think was a good settlement given the risks of this litigation," Berman told The Associated Press.

The proposed deal was filed Wednesday and must receive the approval of U.S. District Judge James Selna, who was expected to review the settlement Friday.

Toyota said it will take a one-time, $1.1 billion pre-tax charge against earnings to cover the estimated costs of the settlement. Berman said the total value of the deal is between $1.2 billion and $1.4 billion.

Hundreds of lawsuits have been filed against Toyota since 2009, when the Japanese automaker started receiving numerous complaints that its cars accelerated on their own, causing crashes, injuries and even deaths.

The cases were consolidated in U.S. District Court in Santa Ana and divided into two categories: economic loss and wrongful death. Claims by people who seek compensation for injury and death due to sudden acceleration are not part of the settlement; the first trial involving those suits is scheduled for February.

The deal includes direct payments to customers as well as the installation of a brake override system in about 3.25 million vehicles, plaintiff attorneys said.?The terms also?include a $250 million fund for former Toyota owners who sold vehicles at reduced prices because of bad publicity, and a separate $250 million fund for owners not eligible for the brake override system.

The settlement would also establish additional driver education programs and fund new research into advanced safety technologies.

"In keeping with our core principles, we have structured this agreement in ways that work to put our customers first and demonstrate that they can count on Toyota to stand behind our vehicles," said Christopher? Reynolds, Toyota vice president and general counsel.

Current and former Toyota owners are expected to receive more information about the settlement in the coming months. Some information is also available at http://www.ToyotaELsettlement.com, a website created for Toyota owners affected by the settlement.

"We are extraordinarily proud of how we were able to represent the interests of Toyota owners, and believe this settlement is both comprehensive in its scope and fair in compensation," Berman said.

Toyota has recalled more than 14 million vehicles worldwide due to acceleration problems in several models and brake defects with the Prius hybrid. Toyota has blamed driver error, faulty floor mats and sticky accelerator pedals for the unintended acceleration.

Plaintiffs' attorneys have spent the past two years deposing Toyota employees, poring over thousands of documents and reviewing software code, but the company maintains those lawyers have been unable to prove that a design defect ? namely Toyota's electronic throttle control system ? was responsible for vehicles surging unexpectedly.

Both the National Highway Traffic Safety Administration and NASA were unable to find any defects in Toyota's source code that could cause problems.

The company has been dogged by fines for not reporting problems in a timely manner.

Earlier this month, NHTSA doled out a record $17.4 million fine to Toyota for failing to quickly report floor mat problems with some of its Lexus models. Toyota paid a total of $48.8 million in fines for three violations in 2010.

Toyota President Akio Toyoda appeared before Congress last year and pledged to strengthen quality control. Recent sales figures show the company appears to have rebounded following its safety issues.

(AP) ? Former President George H.W. Bush is being treated in the intensive care unit at a Houston hospital after suffering "a series of setbacks," including a stubborn fever, his spokesman said.

In a brief email Wednesday, Jim McGrath, Bush's spokesman in Houston, said the 88-year-old former leader had been admitted Sunday to the ICU at Methodist Hospital. McGrath said Bush, the oldest living former U.S. president, was alert and talking to medical staff.

He said doctors are cautiously optimistic about Bush's treatment and that the former president "remains in guarded condition." He said Bush was surrounded by family.

Early Thursday, McGrath told The Associated Press he had no new information on Bush's condition and that he would release another statement "when events warrant it."

Bush has been hospitalized since Nov. 23, when he was admitted for a lingering cough related to bronchitis after having been in and out of the hospital for complications related to the illness.

A fever that kept Bush in the hospital over Christmas had gotten worse and doctors had put him on a liquids-only diet Wednesday following "a series of setbacks."

"It's an elevated fever, so it's actually gone up in the last day or two," McGrath said. "It's a stubborn fever that won't go away."

But he said the cough that initially brought Bush to the hospital had improved.

Bush was visited on Christmas by his wife, Barbara, his son, Neil, and Neil's wife, Maria, and a grandson, McGrath said. Bush's daughter, Dorothy, arrived Wednesday in Houston from Bethesda, Md. The 41st president has also been visited by his sons, George W. Bush, the 43rd president, and Jeb Bush, the former governor of Florida.

He has also been visited by former Secretary of State James A. Baker III, a longtime confidant.

Bush and his wife live in Houston during the winter and spend their summers at a home in Kennebunkport, Maine.

The former president was a naval aviator in World War II ? at one point the youngest in the Navy ? and was shot down over the Pacific. He's skydived on at least three of his birthdays since leaving the White House in 1992.

He suffers from a form of Parkinson's disease and in recent years has used a wheelchair to get around.

No amount of Auto-Tune removes her blue tinge, and strangely, it becomes a salve. The first 10 times I heard ?Diamonds,? her latest (Sia-penned) club banger, I hated its chirpy, overenunciated hook. By the 20th time, though, I started to notice the way Rihanna sings the chorus?s final word, ?sky?: She descends into it with all her weight, like she?s tired but determined to protect herself and her beloved. That heaviness, communicated through unflashy moments of pure feeling, injects calm and tenderness into the swirl and clatter of Rihanna?s music.

I think this submerged, soothing quality factors into Rihanna?s stunning popularity. Who didn?t need a bit of succor in such a difficult year? The children?s choirs that popped up everywhere after the Sandy Hook tragedy struck me as maudlin; yet the mere tone of young voices harmonizing did calm the nerves and help the tears flow a little more gently.
