NFL playoff schedule: Vikings face Packers on Saturday night

Fresh off a win over Green Bay in Week 17, the Vikings will turn around and head to Lambeau Field for an opening-round playoff game against the Packers.

The Minnesota Vikings and Green Bay Packers will meet at 7 p.m. CT next Saturday in the Wild Card round of the NFL playoffs on NBC. Minnesota earned the NFC's No. 6 playoff seed with a last-second 37-34 victory over the Packers in Week 17.

In that victory, Adrian Peterson had another big day, rushing for 199 yards and falling just nine yards short of Eric Dickerson's single-season rushing yardage record. Peterson has more than 400 yards rushing in two games against Green Bay this season; he piled up 210 yards on 21 carries when Minnesota last played at Lambeau Field, though his team lost the game.

Minnesota finished the regular season on a four-game winning streak thanks in large part to Peterson's efforts, ultimately edging the Bears for the final Wild Card spot.

Green Bay finished the regular season 11-5 and won the NFC North, which earned it the No. 3 NFC playoff seed.

5 killed in Oregon tour bus crash on I-84

LA GRANDE, Ore. (AP) ? A tour bus crash crashed Sunday on an icy stretch of interstate in Oregon, killing five people and injuring about 20 others, authorities said.

Police say the bus lost control around 10:30 a.m. on the snow- and ice-covered lanes of Interstate 84 in eastern Oregon. The bus crashed through a guardrail and went down an embankment a few hundred feet.

Rescue workers were using ropes to help retrieve people from the crash scene. State police said the charter bus was carrying about 40 people, but they did not say where the vehicle was traveling to or from.

The bus crash was the second fatal accident in Oregon on Sunday morning due to icy conditions. A 69-year-old man died in a rollover accident

State police have not released information on the company that owns the bus.

Extreme Diet Hacking With Tech: How Cheesecake Made Me Leaner And Stronger With Carb Backloading

photo (39)Never before have I binged on so many delicious desserts, yet been stronger or more ripped. For 3 weeks, I experimented with a cult bodybuilding diet, Carb Backloading, which promises outcomes too good to be true: slam carbs at night after heavy lifting, get slimmer and build muscle. Like all web sensations, there aren't any large scale studies, and anecdotal reviews never properly control for all the right variables. Only a methodical body hacking experiment, with the latest gadgets and devices tracking calorie burn, fat loss, and training intensity, could legitimately test this dream diet. The results? Despite eating a thousand more calories a day--mostly comprised of sundaes and cheesecake--I've maintained my weight, have noticeable ab definition, and increased my strength an average of 37% over all muscle groups.

Experts: New shale fields to help stabilise global oil prices

Oil prices are expected to be fluctuate less in 2013, remaining on a par with or even softening slightly from 2012 levels, say energy experts.

Suthep Liumsirijarern, director-general of the Energy Policy and Planning Office, said North America's new oil shale field will come on stream next year with production of about 500,000 barrels of oil equivalent, causing crude oil imports to the US to drop.

Globally, oil demand will go up slightly from 89 million barrels per day this year to 90 million bpd.

Meanwhile, the economic crisis in Europe and the US economy will not fully recover, resulting in easing oil prices in 2013, he said.

Dubai crude is targeted to trade in a range of US$108-113 a barrel compared with an average of $109.50 this year.

In Thailand, the government's first-time car buyer scheme will drive up petrol demand by 4.9% next year to an average of 21.7 million litres a day from 20 million this year.

Diesel demand will grow by 2.6% to 57.7 million litres a day, while electricity consumption will increase by 6.13% from 161 billion megawatt-hours this year.

"We must prepare for energy-price restructuring after it has been delayed for a long time, involving liquefied petroleum gas (LPG) and compressed natural gas (CNG)," said Mr Suthep.

LPG and CNG prices have been subsidised by the state-owned Oil Fund since 2008, costing about 200 billion baht to date.

Anon Sirisaengtaksin, the chief executive of PTT Global Chemicals Plc, said the petrochemicals industry is unlikely to bottom out next year like analysts estimated since the global economy has remained slow.

Petrochemical demand will come mainly from Asia, where economies remain largely sound, according to Mr Anon.

"We have to wait until the US and European economies bounce back. Then signs [of petrochemical prices] bottoming out will emerge," he said.

Phichai Tinsuntisuk, head of the alternative energy industry club of the Federation of Thai Industries (FTI), said ethanol demand will grow by more than 50% from 1.2 million litres a day this year to 2 million litres a day in 2013.

Major automotive manufacturers have launched vehicles that are compatible with E85 and E20.

Meanwhile, the FTI has called on the government to proceed cautiously with the One Tambon One Power Plant scheme to ensure the success of the plan.

Under the programme, the government will introduce biomass projects for communities in remote areas by offering grants, investment privileges and project financing.

"The government should come up with good planing of this project, as local communities lack the expertise to operate power plants," said Mr Phichai.

2013 Tax Changes That Small Businesses Need to Know ...

As 2012 draws to a close, time is running out for small business owners to plan for potential changes to the tax code. Several tax provisions are set to expire at the end of the year which could have a significant impact on small businesses. While no decisions have been made yet, one of the current proposals is to allow tax cuts to expire only for small businesses making $250,000 or more per year. With the looming changes to the current tax code and the uncertainty surrounding these changes, small business owners need to understand how these changes may affect their business so that they can be prepared.

Changes in Individual and Capital Gains Tax Rates

A vast majority of small businesses are organized in such a way that revenues are taxed at the individual rate instead of the corporate rate. Without action from the federal government, the expiring tax cuts will increase individual tax rates in 2013, resulting in a tax rate hike for many small businesses. The ten percent tax rate would vanish, leaving 15 percent as the lowest rate.? The remaining rates of 25, 28, and 33 percent would go up three percent and the current highest rate of 35 percent would rise to 39.6 percent.

In addition, the capital gains rate would also increase. Gains on assets held longer than a year would be taxed at 20 percent instead of the current rate of 15 percent for middle-income and upper-income taxpayers. The rate for lower income taxpayers would rise to ten percent from zero.

Changes in Business and Estate Tax Rates

If the current tax cuts are allowed to expire, businesses will also face a decrease in the allowable expenses and real property will no longer be included. The start-up deduction for businesses will also be reduced from $10,000 to $5,000.

For business owners looking to leave their business assets to their heirs, or for those who may inherit assets, the maximum estate tax rate would increase from 35 percent to 55 percent. At the same time, the maximum exemption would decrease to $1 million from $5 million.

Reducing Taxes by Increasing Expenses and Deferring Income

The easiest way to reduce income taxes is to either increase deductions or defer income. Small business owners can increase deductions in a variety of ways, including purchasing supplies and equipment before the end of the year to be used in the future. Paying bills early, prepaying for maintenance and subscription plans and making charitable donations can provide significant deductions if done before the end of the year. Depending on the accounting method used, business owners can also depreciate assets to create additional deductions.

Small business owners can defer income by contributing to a qualified retirement plan before the end of the year. Qualified retirement plans include 401(k), IRA, and SEP accounts. Some types of investments, like annuities, also allow investors to defer taxes. Investors avoid paying federal income taxes on the principle and interest until they withdraw the money.

CPAs Can Help Facilitate These Proceedings

Certified Public Accountants (CPAs), can be a valuable professional resource, particularly when it comes to helping business owners identify and take advantage of opportunities to?reduce their income tax burden. In addition to providing guidance and expertise regarding qualified retirement accounts and strategies for deferring income, a CPA can help small business owners manage cash flow, plan for growth, and mitigate risk.

In addition, many CPAs are also well versed in estate planning and can help business owners minimize taxes incurred when business assets are included in an estate. Since the finances of many small businesses are closely linked with the owner?s finances, a CPA can help business owners make sound decisions that benefit both the business and the personal interests of the owner.

San Diego Real Estate: Mortgage Defaults Diving ? CT Homes LLC

Are San Diego foreclosures really declining or is it all more statistical tricks, in an attempt to make the market look healthy?

The latest round of figures from DataQuick and UT San Diego show a steep and steady decline in the local foreclosure rate. The figures show a 15% drop in notices of default being filed between October and November, to half of what we were seeing this time last year. This puts San Diego County at a measly 819 foreclosure notices last month, the lowest rate since August 2006.

This all sounds like incredibly positive news and in combination with rising home sales volume and home prices suggests we truly are in recovery mode if not entering a new boom era.

Still, San Diego real estate prices still have about a 30% climb to go before hitting their previous high, and before we can really call an officially and completely healed market.

However, are these statistics really painting a true picture of the market or are they being skewed by other factors?

Lower foreclosure figures could certainly be accounted for by at least two other factors. The first being the massive trend in short sales. 40,000 Californian homes have reportedly been sold as short sale since the mortgage settlement, but anyway you count them, it means they are being recycled.

The second could be mortgage lenders holding back on actually filing foreclosures. In fact it was just revealed that Bank of America alone has over $64 billion of 180 day or more delinquent home loans on the books which have not had foreclosure notices filed against them.

Fortunately, most real estate agents and investors are actually crying out for more distressed home inventory as we are now down to only about half of the available homes as 3 years ago. If this is accurate, the San Diego foreclosure crisis peaked in 2009.

This would indicate about another 3 years of foreclosures trailing off while San Diego builds on its reputation as one of the healthiest real estate markets in the country.

'Do something!' Americans fed up with D.C. over 'cliff'

Americans from across the country express their frustration with lawmakers in Washington who have yet to reach an agreement on averting looming tax increases.

By Tracy Connor, NBC News

Tennessee Sen. Bob Corker said Friday that ?the American people should be disgusted? the nation?s leaders haven?t been able to avert the fiscal cliff.

Well, mission accomplished.

John Makely / NBC News

Abigail Holt, 17, (right), of Hartford, Conn., says Washington's inability to avert the fiscal cliff is "annoying."

Across the country, people are shaking their heads about negotiations that go nowhere and fingers that point everywhere while the nation hurtles toward the precipice of a new economic crisis.

?They should make a plan, make up their minds and do something!? Abigail Holt of Hartford, Conn., told NBC News.

She?s 17 years old and admits she?s just learning about the federal government and the fiscal cliff. But she knows this much: ?It?s annoying.?

And that's being polite.

Writing in the Daily Beast, Howard Kurtz called the nation's capital "the country?s biggest day-care center." The famous sex therapist Dr. Ruth Westheimer hit below the belt, noting on Twitter that "Members of Congress who can't compromise probably aren't good lovers."

Californian Pat Marshall said the politicians "appear to be very self-centered on making sure that they?re taken care of and the American public comes second."

After an hourlong meeting Friday with congressional leaders that he described as "constructive," President Obama acknowledged that people outside Washington were bewildered by D.C. "dysfunction" and that time -- and patience -- were running out.

Lawmakers have 'lost touch'
Indeed, with higher taxes and deep spending cuts looming without a deal, Americans? faith in Washington is dissipating by the day.

A Dec. 9 Gallup poll found that 59 percent thought it was likely the White House and Congress could hammer out a deal to avoid a slide down the cliff; by this week, that had sunk to 50 percent.

Skeptics were gaining ground, meanwhile: 48 percent think an agreement before the year-end deadline is unlikely, up 10 points from two weeks earlier.

John Makely / NBC News

Rich Dodds, 49, of Houston, Texas, says the elected officials in Washington have "lost touch" with Americans who will be affected by the fiscal cliff.

?It doesn?t feel like they?re doing much,? said Rich Dodds, 49, an energy product manager from Houston, Texas. ?I think they?ve lost touch with who the American people are. It?s a pretty elite group in Washington.?

The fact that both houses of Congress went into recess -- the Senate took a nearly week-long break, and the House is still on vacation until Sunday -- bothered some.

?This is one of the most important issues and they are not even working,? said Bill Prosser, 49, a telecommunications salesman from Clifton, Va. ?I?m very disappointed in them.?

Nicole Hayward, 28, of Brooklyn, N.Y., was so angered by the congressional recess that she posted a petition on Change.org demanding lawmakers get back to business.

?I turn on the news every day while I?m getting ready for work and I saw coverage about how Congress was going to break for the holidays and we might not have a resolution,? the marketing director said. ?I thought, who cares about their holiday vacation? It really got me going.?

Hayward got only 101 signatures on her petition. She attributed the lack of interest to cynicism.

?The reason why the average American doesn?t pay attention to this issue and the details is they think Congress will come together and pass something that just kicks the can down the road and things won?t change in [their] life,? she said.

John Makely / NBC News

Bill Prosser, 49, of Clifton, Va., says members of Congress should be locked in a room until they can make a deal.

Bipartisan blame
Inside the Beltway, Democrats are condemning Republicans and vice versa for the stalemate. But the nation?s voters are more bipartisan in their blame, with neither Republicans nor Democrats obtaining majority support.

?Essentially, right now, 25 percent of the public approves of the job the GOP congressional leaders are doing and 40 percent approves of the job the Democratic leaders are doing,? said Jocelyn Kiley, a senior researcher for the Pew Research Center for the People & the Press.

Prosser thinks there?s a time-tested way to bring the two sides together before Jan. 1 -- something akin to the old papal conclaves in which cardinals were locked in a room until they chose a new pontiff.

?Just say you?re not going to leave until you have a deal,? Prosser said.? ?Get in a room -- and get it done!?

Who do you blame for the nation teetering on the edge of the fiscal cliff?

?

Trying to halt hepatitis C's molecular hijacking

Dec. 27, 2012 ? Researchers at the University of Colorado School of Medicine have figured out intimate details of how the hepatitis C virus takes over an invaded cell, a breakthrough that could point to way for new treatments for the virus.

Hep C hijacks the machinery by which a cell makes proteins and uses it instead to create proteins for the virus. Over the last two decades, researchers have figured out that Hep C uses an RNA molecule to do this. Now they're trying to fill in the details.

One key detail is reported in a paper published online Dec. 23 in Nature Structural and Molecular Biology. It's written by Jeffrey Kieft, PhD, an associate professor at the CU medical school's Department of Biochemistry and Molecular Genetics and an Early Career Scientist of the Howard Hughes Medical Institute, and his former graduate student, Megan Filbin, PhD, a graduate of the Program in Molecular Biology.

Working with researchers from the lab of Tamir Gonen at the Janelia Farm Research Campus of the Howard Hughes Medical Institute, Kieft used ultra high-power electron microscopes to take images of individual RNA molecules from Hep C as they interacted with the cell's machinery. The researchers combined those images with a variety of other experiments and these clues led them to identify a new way that the virus' RNAs takes over the cell's machinery.

Specifically, the researchers focused on how a ribosome, the cell's protein-making factory, can be manipulated by the Hep C RNA to affect a part of the protein process called translocation. And they saw something else -- that even very small changes in the interactions important for that hijacking process can be blocked.

"This points the way to developing drugs to fight hepatitis C in ways that current therapies do not," Kieft says.

Introducing phon.es - our new URL shortener for Android Central and Mobile Nations!

phon.es

We've talked a bit in the past about URL shorteners and how they can save space -- or wreak havoc. It's really all about trust, right? We've used third-party shorteners like bit.ly before, and since then we've been using Google's own shortener, goo.gl. Now we've got our own.

From here on out, if you see a link to phon.es (it's phones, get it?), you can rest assured that it's from us. Actually, it's from any one of the Mobile Nations sites, which comprises Android Central, CrackBerry, WPCentral, iMore and webOS Nation.

So when will you see a phon.es link? Most likely it'll be on a service like Twitter or App.net, where characters are at a premium. So instead of http://www.androidcentral.com/lg-nexus-4-review, you'll see http://phon.es/n4review -- or something even shorter.

Nobody knows phones better the members of Mobile Nations, and phon.es is just one more way we're continuing to improve Android Central, the Mobile Nations network, and life on Earth in general. Enjoy!

Starvation didn't wipe out saber-toothed cats

Saber-toothed cats apparently did not go extinct for lack of prey, contradicting a popular explanation for why they died off, fossil evidence now suggests.

Even near their extinction, saber-toothed cats likely had enough to eat, researchers noted.

Saber-toothed cats, American lions, woolly mammoths and other giant creatures once roamed across the American landscape. However, at the end of the late Pleistocene about 12,000 years ago, these "megafauna" went extinct, a die-off called the Quaternary extinction.

"The popular theory for the megafaunal extinction is that either the changing climate at the end of the last ice age or human activity, or some combination of the two, killed off most of the large mammals," said researcher Larisa DeSantis, a vertebrate paleontologist at Vanderbilt University in Nashville.

    1. The year's top ancient mysteries (and missteps)

The past year saw plenty of controversy over ancient mysteries ? and we're not just talking about Maya prophecies. So what happened to "Franken-saurus," the Gospel of Jesus' Wife and the plan to clone a woolly mammoth?

    4. Peru's mysterious Nazca Lines form a labyrinth

"In the case of the great cats, we expect that it would have been increasingly difficult for them to find prey, especially if had to compete with humans. We know that when food becomes scarce, carnivores like the great cats tend to consume more of the carcasses they kill. If they spent more time chomping on bones, it should cause detectable changes in the wear patterns on their teeth."

Tale of the teeth
To learn more about saber-toothed diets, the researchers analyzed the fossil teeth of 15 saber-toothed cats (Smilodon fatalis) and 15 American lions (Panthera atrox) recovered from the La Brea tar pits in Los Angeles. These specimens ranged from about 11,500 to 35,000 years in age.

To study the fossils, the scientists used dental microwear texture analysis, developed by anthropologist Peter Ungar at the University of Arkansas. This involves using generating three-dimensional images of a tooth's surface. The image is then analyzed for microscopic grooves ? devouring red meat produces small parallel scratches, while biting on bones lead to larger, deeper pits.

The investigation found the pattern of wear on the teeth of the saber-toothed cat most closely resembled those of present-day African lions, which sometimes crush bone when they eat. The wear pattern on American lion teeth, on the other hand, echoed that of the present-day cheetah, which deliberately avoids bones when it feeds. [ Photos: A Lion's Life ]

Analysis of both older fossils and more recent ones did not reveal any evidence that patterns of wear changed over time, and none had extreme microwear like living hyenas, which consume entire carcasses, bones included. This suggests that prey for these carnivores was not scarce ? the animals were not gnawing their victims to the bone.

"Tooth wear patterns suggest that these cats were not desperately consuming entire carcasses, as was expected, and instead seemed to be living the 'good life' during the late Pleistocene, at least up until the very end," DeSantis said.

Big predator extinction
Past research of teeth from American lions, saber-tooth cats, dire wolves and coyotes from La Brea revealed they experienced three times the number of broken teeth of contemporary predators, hinting that these species were having trouble finding prey and were thus urgently devouring or "processing" whole carcasses. This led scientists to suspect that climate change and human competition were making life tough for the big predators.

Instead, DeSantis and her colleagues argue this high rate of damage seen in teeth more likely resulted during capture of prey instead of feeding on carcasses.

"We expected extinct carnivores to show evidence for extreme bone processing, based on the high number of broken teeth determined from prior research. Finding the complete opposite pattern was shocking!" DeSantis said.

The researchers noted that saber-toothed cats were about the size of today's African lion, while the American lion was about 25 percent larger. They fed on giants such as mammoths and four-ton giant ground sloths. The fact these ancient carnivores and their prey were bigger than contemporary predators and their victims could help explain why the extinct cats had more broken teeth than their living brethren, the investigators said. . [ Gallery: Today's Threatened Mammals ]

Specifically, larger teeth break more easily than smaller teeth, so larger carnivores may be likely to break more teeth when attempting to take down larger prey. The researchers noted past studies that found the canines of a predator the size of fox can support more than seven times the fox's weight before breaking, while a carnivore the size of lion can only support about four times its weight and the curved teeth of saber-toothed cats could only support about twice the animal's weight.

"The net result of our study is to raise questions about the reigning hypothesis that 'tough times' during the late Pleistocene contributed to the gradual extinction of large carnivores," DeSantis said. "While we can not determine the exact cause of their demise, it is unlikely that the extinction of these cats was a result of gradually declining prey."

Currently, the scientists are examining other carnivores at the La Brea tar pits, "including the extinct giant short-faced bear and the extant mountain lion that is found both during the Pleistocene at La Brea and in southern California and elsewhere today," DeSantis told LiveScience.

"Essentially, we are trying to clarify the biology and diets of these carnivores during the past to further evaluate why the short-faced bear went extinct and, potentially, why the mountain lion did not."

DeSantis and Ungar, with their colleagues Blaine Schubert and Jessica Scott, detailed their findings online Dec. 26 in the journal PLOS ONE.

Dragonfly Shows Human-Like Power of Concentration

Dragonflies lack humans' big brains, but they still get the job done, according to new research that suggests that these insects have brain cells capable of feats previously seen only in primates.

Specifically, the dragonflies can screen out useless visual information to focus on a target, a process called selective attention. The new study, published Dec. 20 in the journal Current Biology, is the first to find brain cells devoted to selective attention in an invertebrate animal.

Selective attention is crucial for responding to one stimulus among the dozens of distractions that clamor for notice at any given time, said Steven Wiederman of the University of Adelaide in Australia.

"Imagine a tennis player having to pick out a small ball from the crowd when it's traveling at almost 200 kilometers an hour," Wiederman said in a statement. "You need selective attention in order to hit that ball back into play."

But little is known about how the brain locks onto its targets and ignores all else. To find out, Wiederman, who is from the university's Center for Neuroscience Research, and his colleague David O'Carroll turned to an unlikely animal. The researchers have long studied insect vision, and the dragonfly turns out to be quite adept in that arena. [Photos: Dew-Covered Dragonflies & Other Sparkling Insects]

?

"The dragonfly hunts for other insects, and these might be part of a swarm ? they're all tiny moving objects," Wiederman said. "Once the dragonfly has selected a target, its neuron activity filters out all other potential prey. The dragonfly then swoops in on its prey ? they get it right 97 percent of the time."

Using a glass probe with a tip 1,500 times smaller than a human hair, the researchers measured the neuronal activity that enables such amazing aerial hunting. A similar process is at work in the primate brain, O'Carroll said in a statement, but researchers weren't expecting to see the same thing in an insect that evolved 325 million years ago.

"We believe our work will appeal to neuroscientists and engineers alike," O'Carroll said. "For example, it could be used as a model system for robotic vision. Because the insect brain is simple and accessible, future work may allow us to fully understand the underlying network of neurons and copy it into intelligent robots."

Plenty of other insects have inspired robot designs. Swiss scientists, for example, have built a hovering drone that mimics insects in its ability to survive collisions with hard objects. Sometimes insects are recruited directly. North Carolina State University researchers reported in September that they'd managed to create cyborg Madagascar hissing cockroaches. The scientists wired a microcontroller to the insects' sensory organs, enabling them to steer the cockroaches' movements.

The Shift to Merit Based Scholarships ? Center for Christian ...

The Article: States Shift to Merit Scholarships
The Source: The Wall Street Journal
The Author: Jennifer Levitz and Scott Thurm
The Date: 12/23/12

More than 25 states award some financial aid for college students based on academic achievement, as opposed to need. Thirteen states, primarily in the South, award more than half of their financial aid based on merit.

Now that movement may be picking up steam.

Last year, with Georgia?s scholarship program facing financial distress, lawmakers decided to increase the academic requirements for scholarships. Administrators say the change will help keep the program solvent. But it also wound up funneling a greater portion of the remaining aid to higher-income students.

Georgia?whose Hope scholarship program is among the largest merit-based programs in the country?is at the forefront of a growing national debate over state-backed financial aid for college students. Should states direct aid to the highest-achieving students, regardless of income? Or should the money go to poorer students?

Scholarship image

Proponents of merit, or some combination of merit and need, say focusing on achievement helps reduce a ?brain drain? of talented residents leaving home states, and rewards those who study hard and apply themselves.

Though the trend rarely gets much attention and is obscured by increases in federal grants to poor students, 27 states have created some sort of merit-aid program since Georgia launched its own in 1993.

Of those, 13 states based over half of their grant money on merit in 2010-2011, the latest year available. In Arkansas, Louisiana, Mississippi, South Dakota and Georgia, more than 85% of grants were merit-based.

Now, with funding for the scholarships falling behind steady hikes in college tuition and in the number of kids receiving them, lawmakers in Tennessee, South Carolina, New Mexico and other states are weighing some tough calls on how to distribute their grants.

For its part, Georgia rejected proposals by some lawmakers for an income cap and decided instead to require better grades and, for the first time, strong SAT or ACT test scores for full-tuition scholarships.

Digging Deeper:

How does a state balance the need for responsible budgets, with a desire to make college more affordable for all people?
Do they have a moral obligation to make a college education accessible to all people?
Does this trend in merit based scholarships represent a new form of de facto discrimination?

Toyota settlement will top $1 billion

15 hrs.

Toyota Motor Corp. has agreed to pay as much as $1.4 billion to settle U.S. litigation claims that its vehicles suddenly and unintentionally accelerated, according to court filings made public Wednesday.

The company said the deal will resolve hundreds of lawsuits from Toyota owners who said the value of their cars and trucks plummeted after a series of recalls stemming from claims that Toyota vehicles accelerated unintentionally.

Steve Berman, a lawyer representing Toyota owners, said the settlement is the largest in U.S. history involving automobile defects.

"We kept fighting and fighting and we secured what we think was a good settlement given the risks of this litigation," Berman told The Associated Press.

The proposed deal was filed Wednesday and must receive the approval of U.S. District Judge James Selna, who was expected to review the settlement Friday.

Toyota said it will take a one-time, $1.1 billion pre-tax charge against earnings to cover the estimated costs of the settlement. Berman said the total value of the deal is between $1.2 billion and $1.4 billion.

Hundreds of lawsuits have been filed against Toyota since 2009, when the Japanese automaker started receiving numerous complaints that its cars accelerated on their own, causing crashes, injuries and even deaths.

The cases were consolidated in U.S. District Court in Santa Ana and divided into two categories: economic loss and wrongful death. Claims by people who seek compensation for injury and death due to sudden acceleration are not part of the settlement; the first trial involving those suits is scheduled for February.

The deal includes direct payments to customers as well as the installation of a brake override system in about 3.25 million vehicles, plaintiff attorneys said.?The terms also?include a $250 million fund for former Toyota owners who sold vehicles at reduced prices because of bad publicity, and a separate $250 million fund for owners not eligible for the brake override system.

The settlement would also establish additional driver education programs and fund new research into advanced safety technologies.

"In keeping with our core principles, we have structured this agreement in ways that work to put our customers first and demonstrate that they can count on Toyota to stand behind our vehicles," said Christopher? Reynolds, Toyota vice president and general counsel.

Current and former Toyota owners are expected to receive more information about the settlement in the coming months. Some information is also available at http://www.ToyotaELsettlement.com, a website created for Toyota owners affected by the settlement.

"We are extraordinarily proud of how we were able to represent the interests of Toyota owners, and believe this settlement is both comprehensive in its scope and fair in compensation," Berman said.

Toyota has recalled more than 14 million vehicles worldwide due to acceleration problems in several models and brake defects with the Prius hybrid. Toyota has blamed driver error, faulty floor mats and sticky accelerator pedals for the unintended acceleration.

Plaintiffs' attorneys have spent the past two years deposing Toyota employees, poring over thousands of documents and reviewing software code, but the company maintains those lawyers have been unable to prove that a design defect ? namely Toyota's electronic throttle control system ? was responsible for vehicles surging unexpectedly.

Both the National Highway Traffic Safety Administration and NASA were unable to find any defects in Toyota's source code that could cause problems.

The company has been dogged by fines for not reporting problems in a timely manner.

Earlier this month, NHTSA doled out a record $17.4 million fine to Toyota for failing to quickly report floor mat problems with some of its Lexus models. Toyota paid a total of $48.8 million in fines for three violations in 2010.

Toyota President Akio Toyoda appeared before Congress last year and pledged to strengthen quality control. Recent sales figures show the company appears to have rebounded following its safety issues.

Information from the Associated Press and Reuters was included in this report.

Using Google + Ads for your Small Business.

Posted by jtolman to on December 27th, 2012

Google + is powering full speed ahead to compete with the largest social networks, such as Facebook, Twitter, and LinkedIn.? With now 100 million active users, as of September 2012, Google + is definitely worth keeping an eye on.? Google + has just recently added Communities, a new feature similar to that of Facebook?s Groups.? They have made it no secret that they are directly competing with Facebook as the ultimate social network with added features and benefits.? That is why it makes sense for them to now move into the advertising arena, matching Facebook Ads with Google + ads.

?

Google + ads are now active and available to select US brands on Google +, according to this post by Google?s Christian Oestlien.? Google + will presumably be using AdWords Express to roll out this feature for Google + page owners to advertise their pages.? By offering these ads, this will be first time Google + page owners will be able to pay to promote their pages.? Whereas, Facebook page owners have been able to pay for promotion for quite a while now.? However, there is a major difference between Facebook ads and Google + ads.? Facebook ads are only placed within the social network itself, and they do not expand beyond that reach.? Google + won?t be promoting within Google+ itself, but instead they will be promoting ads on their existing external ad networks.? The ads will exist in the same place where Google search ads already are: Google search, Google maps, and other Google properties.? Instead of creating interruptive advertising like Facebook, these ads will only appear to those who are intentionally searching for related information.? The benefit of this strategy is that your ads will reach customers at their moment of intent, when they actually want to buy what your business is selling.

?

As you can see from the screenshots above, you will soon be able to use Google AdWords Express to Connect with new customers and control how much and when you pay.? You can currently create ads via Google AdWords for your Twitter or Facebook pages, but soon you will be able to promote your Google + page as well.? What?s great about what is to come is that Google will actually find the best places to promote it.? They?ll do the dirty work for you, so you don?t have to spend your time on keywords, bids, or placement.? By using Google + ads, you will have more time to focus on selling rather than spending that time promoting.

(AP) ? Former President George H.W. Bush is being treated in the intensive care unit at a Houston hospital after suffering "a series of setbacks," including a stubborn fever, his spokesman said.

In a brief email Wednesday, Jim McGrath, Bush's spokesman in Houston, said the 88-year-old former leader had been admitted Sunday to the ICU at Methodist Hospital. McGrath said Bush, the oldest living former U.S. president, was alert and talking to medical staff.

He said doctors are cautiously optimistic about Bush's treatment and that the former president "remains in guarded condition." He said Bush was surrounded by family.

Early Thursday, McGrath told The Associated Press he had no new information on Bush's condition and that he would release another statement "when events warrant it."

Bush has been hospitalized since Nov. 23, when he was admitted for a lingering cough related to bronchitis after having been in and out of the hospital for complications related to the illness.

A fever that kept Bush in the hospital over Christmas had gotten worse and doctors had put him on a liquids-only diet Wednesday following "a series of setbacks."

"It's an elevated fever, so it's actually gone up in the last day or two," McGrath said. "It's a stubborn fever that won't go away."

But he said the cough that initially brought Bush to the hospital had improved.

Bush was visited on Christmas by his wife, Barbara, his son, Neil, and Neil's wife, Maria, and a grandson, McGrath said. Bush's daughter, Dorothy, arrived Wednesday in Houston from Bethesda, Md. The 41st president has also been visited by his sons, George W. Bush, the 43rd president, and Jeb Bush, the former governor of Florida.

He has also been visited by former Secretary of State James A. Baker III, a longtime confidant.

Bush and his wife live in Houston during the winter and spend their summers at a home in Kennebunkport, Maine.

The former president was a naval aviator in World War II ? at one point the youngest in the Navy ? and was shot down over the Pacific. He's skydived on at least three of his birthdays since leaving the White House in 1992.

He suffers from a form of Parkinson's disease and in recent years has used a wheelchair to get around.

The Music Club, 2012

This exchange has been ridiculously stimulating and challenging. Thanks for the suggestions (downloading those Cassie mixtapes right now, Lindsay) and the shout-outs to music I wrongly overlooked on my lists? Will, Theo Bleckmann?s version of? ?Army Dreamers? is my fave Kate Bush cover evah. We did a darn good job covering pop?s bases in the midst of Yule logging and/or getting Chinese and a movie on this chopped and Scrooged holiday.

However. There is one subject we?ve mostly left untouched, maybe because it?s such an uncomfortable one. Jason opened the door for us to discuss Rihanna?s strange year of triumphs and provocations, pointing to her influence on the nature of stardom itself, which grows in direct proportion to her obnoxiousness. I was really hoping one of you would enter this treacherous area, but I?m up last, so here I go.

I call Rihanna obnoxious even though I?m her conflicted (and lately fading) fan, because I think it?s important to acknowledge that this massively successful 24-year-old is an active player in a narrative that drives culture-arbiters like us crazy. How could she? we ask ourselves on repeat as she consorts with her prototypical Wrong Man, indulges in excess that?s highly inappropriate for this age of austerity, and cranks out hit after mind-numbing hit. (I?m particularly peeved by the one that I associated with a sweet ad for Comfort Inn until she seized and strangled it.)

Just like the rise of the Real Housewives and Honey Boo-Boo, Rihanna?s saga implicates all of us, because we?re the ones following her on Twitter, downloading her duets with that thug (her word, not mine), and returning to the 2009 police report of her beating at his hands, all while sternly saying our interest is strictly cautionary. In response, Rihanna play-acts rebellion in ways that wreck observers? expectations. She?s a victim? It?s nobody?s business. (Billie Holiday sang that once, too.) She?s a survivor? She declares herself ready to die. She?s finally free? ?Boy, I just wanna be in your possession,? she sings, cuddling Chris Brown courtside.

Those last examples all come from this year?s Unapologetic, an album that vexed even the critics who liked it. Its mix of what seems disturbingly personal and what works as purely commercial supports Rihanna?s projects of taking hold of her own story and refusing to make it palatable. As I?m reading her motives right now, they align with those of many famous women who?ve come to experience public life as a violation. Choosing a companion others condemn is a time-honored way of poking holes in a confining persona. The most relevant comparison to Rihanna is Whitney Houston, whose love for a dangerous bad boy contributed to her eventual destruction. But you can go all the way back to Fanny Brice, who married the low-level gangster Nicky Arnstein in 1918, a choice that put a dent in her flourishing vaudeville career.

Brice?s disastrous marriage also gave her a signature song: ?My Man,? which is so close in spirit to some of Rihanna?s recent ballads that I?m hoping for a David Guetta remix. Pop audiences have always fed off the pathos of stars. Want inspiration? Listen to this speech by Lana Wachowski?or the latest Pink album, The Truth About Love, which deals with many of the same issues that fascinate Rihanna but has more humor and wisdom, not to mention serious belting.

If Rihanna?s music fails to inspire or instruct, it does continue to do something unexpected. Her voice comforts. I?m always surprised at how many writers use words like ?blank? or ?distanced? to describe Rihanna?s voice. I think its limitations?a constricted range, no falsetto, no real sense of phrasing?make it all the more believable, communicating uncertainty and an acute awareness of pain. No amount of Auto-Tune removes her blue tinge, and strangely, it becomes a salve. The first 10 times I heard ?Diamonds,? her latest (Sia-penned) club banger, I hated its chirpy, overenunciated hook. By the 20th time, though, I started to notice the way Rihanna sings the chorus?s final word, ?sky?: She descends into it with all her weight, like she?s tired but determined to protect herself and her beloved. That heaviness, communicated through unflashy moments of pure feeling, injects calm and tenderness into the swirl and clatter of Rihanna?s music.

I think this submerged, soothing quality factors into Rihanna?s stunning popularity. Who didn?t need a bit of succor in such a difficult year? The children?s choirs that popped up everywhere after the Sandy Hook tragedy struck me as maudlin; yet the mere tone of young voices harmonizing did calm the nerves and help the tears flow a little more gently. I want to leave you with this notion of comfort, an often overlooked but crucial offering of pop music. And the great imperfect voice that conveyed it better than anyone?s in 2012 belonged to Leonard Cohen.

At least one high-profile ersatz choir?the cast of The Voice?turned to Cohen?s much-abused modern hymn, ?Hallelujah,? in the wake of Sandy Hook. There?s no need to go to that old saw. In February, the 78-year-old guru-rabbi-king of the ladies? men released Old Ideas, a song collection that communicates everything necessary about loss: how much it hurts, how the mind tries to make up for it, how it owns every mortal in the end. And, crucially, Cohen dwells deeply within the reality that loss defines being alive. His baritone a snowy croak lit up from within, Cohen cries with the pain of a shattered heart. But as always, he welcomes the brokenness:

If your heart is torn
I don?t wonder why
If the night is long
Here?s my lullaby
