Recipe: One Bowl Mung Bean Meal Recipes from The Kitchn | The ...

2012-11-29-mung-bean-salad-final.jpgIt happens every year at this time and you know it. Whatever your normal ? and hopefully healthy ? eating pattern is, you lose it.

Normally I have a very balanced diet, which not only means it's balanced nutritionally, but it's balanced emotionally: I manage to try everything I want while rarely over-indulging. Then the holidays hit and gatherings fill up the calendar. On one hand I can't complain; I've managed to make a career out of encouraging people to cook and eat together, and it doesn't happen more than at the end of each calendar year. However, these gatherings rarely showcase light, healthy foods. Don't get me wrong: I like a good boozy cup of eggnog and a slice of roast beef as much as the next guy, but everybody needs a break.

Take Tuesday night for example: I went into a dinner party situation wanting to eat light and not drink alcohol. Two blinks of the eye later I found a margarita in one hand and a goat cheese-stuffed, bacon-wrapped date in the other. Pretty soon there were pork loin sandwiches and chile rellenos. There was simply no escape.

All you can do is plan to eat differently when possible. This is a time, more than ever, to retreat to the one-bowl vegetarian meal. Lately, that's meant it's all about mung beans at my house. Sometimes the servings are small, just enough to tide me over.

I'm offering this recipe, like I do with many of my recipes, simply to guide you. Of course, if you are missing any of the ingredients like apples or avocados, replace them with something else: some leftover stir-fried greens, a chopped up boiled egg, sky's the limit. This is a good opportunity to clear the decks and the formula couldn't be easier.

In terms of the sprouted mung beans, they are usually easy to find at any large health food store or Whole Foods. I like them because they don't really require much cooking, and they feel so nourishing. If you can only find regular mung beans, don't fret. Simply cook the beans according to the package's instructions then drain and toss with the other salad ingredients.

The point here is to give your system a break and of course there's no one recipe for this practice. Just allow your system to breathe, and take refuge in a bowl of clean food. We have a whole month of holiday eating ahead, so pace yourself. Have a bowl of mung beans, then brace yourself for the next onslaught of holiday cheer.

One Bowl Mung Bean Meal

Serves 4

1 cup sprouted mung beans
3 cups water or broth
4 chopped green onions, white and pale green parts only
2 ribs celery, trimmed and sliced cross-wise into c-shapes
1 apple, diced
1 ripe avocado, sliced
1/3 cup chopped almonds
1/4 cup tablespoons olive oil
3 tablespoons loosely packed chopped Italian parsley
2 tablespoon lemon juice
sea salt and freshly ground black pepper, to taste

Bring the water to boil in a medium saucepan. Add the mung beans and gently boil for 5 minutes. Remove the pan from the heat. Cover and let stand for at least 4 minutes and up to 8 minutes, depending on the desired texture. Drain.

Mix the mung beans with the green onions, celery, apple, avocado, almonds, olive oil, parsley, lemon juice and salt and pepper. Toss well. Divide between two bowls and serve.

Today, President Serzh Sargsyan has arrived to the Republic of Lebanon of the official visit

At the residence of the President of Lebanon, after the official ceremony of welcoming the President of Armenia, Presidents Serzh Sargsyan and Michel Suleiman conducted private negotiations which were followed by the negotiations in the extended format with the participation of the delegations of the two states.

After the negotiations, there took place the ceremony of signing official documents. In particular, signed were Agreements on the ?Visa free regime for the holders of diplomatic and service passports? and ?Mutual recognition of the higher education and academic titles.?

After the ceremony of document signing, President Serzh Sargsyan planted a tree in the Presidential Garden as a token of the Armenian-Lebanese friendship.

At the Presidential residence, the President of Armenia Serzh Sargsyan and the President of the Republic of Lebanon Michel Suleiman recapped the results of the negotiations at the joint press conference.

?Dear Mr. President,
Ladies and Gentlemen,

I once again express my thanks to President Suleiman for the invitation to visit the friendly Lebanon and warm welcome extended to the delegation of Armenia. Last year, at the 20th anniversary of Armenia?s independence, we had the honor to host the President of Lebanon in Armenia. This year, the President of the Republic of Armenia is conducting an official visit to Lebanon; the regularity of these visits speaks about the high-level dialogue established between our two countries, high-level relations of our two countries, and the desire to further deepen these relations.

Moments ago, we held productive negotiations with President Suleiman: we have discussed opportunities of engaging new areas in the Armenian-Lebanese cooperation, exchanged views on the international, particularly, Middle East and South Caucasus developments. We have also reiterated that our relations are based on good will, mutual trust and respect.

This year is special, since we mark the twentieth anniversary of the establishment of diplomatic relations. We have noted with satisfaction that the interparliamentary, cultural, educational and scientific ties have been established, signed were over three dozens of documents, whose number will be augmented during this visit, or to be more precise, has already been augmented by two.

We have agreed to use every opportunity to boost our bilateral economic cooperation. We are glad that in the recent period presence of Lebanon in our economy has become more visible.

I have told President Suleiman about the importance we attach to the cooperation with Lebanon on the international arena. In forming its positions, Armenia takes into consideration pan-Arabic interests and interests of Lebanon in particular.

We are deeply concerned with the situation in Syria and with the fate of the Armenians living there. At the gravest time in our history, the people of Syria had heartily received hundred of thousands of the Armenians, and their pain is our pain.

Armenia has always expressed the viewpoint that the bloodshed must stop. We are against the use of force and violence, and not only in Syria. It is impossible to reach a durable resolution without cessation of all clashes from all sides or without a comprehensive political dialogue, which will take into consideration interests of all Syrians. Armenia welcomes the mission of the Special Envoy of the UN Secretary General and Arab League, Mr. Lakhdar Brahimi, aimed at the stabilization of the internal situation and establishment of peace.

Please be assured that if the mentioned above initiatives are called to life, there will be peace in Syria and in the nearest future it will be possible to implement democratic reforms which will reflect the collective will and aspirations of all segments of the Syrian people.

We have also spoken about the NK conflict resolution. We have reiterated that in the South Caucasus, Armenia continues to conduct a policy aimed at the establishment of peace and stability in the region. We rule out any possibility of the use of force and remain true to our commitment to solve the problem through the negotiations with the mediation of the OSCE Minsk Group. Unfortunately, the neighboring Azerbaijan rejects every proposal of the Minsk Group aimed at the confidence building and continues an unprecedented accumulation of weapons, preparing its people for a new war. It is gaudily proved by pardon extended to the murderer Safarov by the President of Azerbaijan and his glorification. It constitutes the continuation of the murder, conducted on ethnic grounds, and presents a telling example of xenophobia and racism.

The Armenians and Lebanese have always stood out for their love for peace. Today too, we have concurred with President Suleiman that changes which reflect the will of the people should be implemented through peaceful means, without use of force, without victims, without terrorism. We learned with great sorrow the news of a terrorist act in Beirut on October 19 and did not hesitate to condemn such a repulsive act which, we hope, will not shatter peace in Lebanon. Present situation in the Middle East is tightly linked to the security of Armenia. We are deeply interested in a speedy resolution of the existing problems and are ready to assist the process within the limits of our capabilities.

In conclusion, I wish that the historical procession of our brotherly nations will be incessant and upward. Let peace, justice and optimism be our constant companions.?

Wall Street isn't backing Jack Lew for Treasury - The Term Sheet ...

FORTUNE -- Jack Lew, the frontrunner to be named Treasury Secretary in Obama's second term, isn't Wall Street's first choice for the key economic post. He's not even its second.

"I've talked to a bunch of investors and it's seen as a net negative going from [Tim] Geithner to Lew," says Chris Krueger, senior political analyst at Guggenheim Partners. "Who does Wall Street want? Not Jack Lew."

Lew,?57, spent three years on Wall Street working at Citigroup (C) as the chief operating officer of its alternative asset investment management unit. One of the funds Lew's group invested in was run by John Paulson, who at the time was betting heavily against the housing markets and banks. But that's not the part of Lew's resume that anyone seems to remember. And it's certainly not the important part.

After Lew, a Queens, New York native, graduated from Harvard University and Georgetown Law, he headed straight to Washington and has mostly stuck inside the Beltway ever since. He's been on teams credited with brokering major budget deals. He worked for Tip O'Neill when the House speaker struck a deal to raise taxes and cut benefits with President Reagan. And Lew was a key member of President Clinton's budget team, which simultaneously erased the deficit and struck a long-term deal with Republicans to preserve entitlements.

Under Obama, Lew served as the head of the Office of Budget and Management, and a year ago he became Obama's chief of staff.

Since the election Obama has seemingly been trying to patch things up with Wall Street, which threw its collective support behind Romney. After the election, Obama called JPMorgan Chase (JPM) CEO Jamie Dimon and other business leaders. And Lew recently met with Dimon to talk about the fiscal cliff. Geithner is expected to exit the Treasury job early next year.

Nonetheless, some financial executives say that if Obama were to choose Lew for Treasury Secretary, it would signal that the president is not as serious about mending his relationship with corporate leaders as he says. Wall Streeters say the two other candidates who are considered in the mix for the job, former investment banker and two-time second Erskine Bowles and BlackRock (BLK) CEO Larry Fink, would be preferable to Lew. Bowles has been a deficit hawk, and Fink clearly knows the debt market. What's more, unlike Lew, neither one would need an introduction to Wall Street.

Don Marron, a dean of Wall Street who was also once rumored to be a top pick for the Treasury Secretary job (under a Bob Dole presidency in 1996), says he doesn't know Lew, or where he stands on business issues. And Marron?says that will be a problem for corporate America and the market. "Lew will be more of an unknown at a time when you don't want unknown," he says.

Strangely enough, Democrats don't seem so excited about Lew either. They don't think he will be tough enough on Wall Street. And by picking Lew, who has little background in regulating financial markets, Obama would signal that he is more focused right now on striking a budget deal, and less focused on further tinkering with the rules on Wall Street.

Lew wouldn't be the first Treasury Secretary to come from more of a political background instead of Wall Street or corporate America. James Baker, for instance, served as the Treasury Secretary during Reagan's second term.?But the relationship between the Treasury Secretary and Wall Street matters more than it used to. One of the legacies of Tim Geithner, who is a lifetime regulator, has been to focus the position more on market regulation. The Treasury Secretary is now the head of the Financial Stability Oversight Council, the newly formed team of regulators that is supposed to be on the lookout for risks that could cause future crises. And the relationship between the economy and the market's performance is much closer than it was back in Baker's day.

So some of this can be dismissed as more Masters of the Universe griping they are not being heard by Obama. But not all of it.

Microsoft Type Cover (for Surface)


With the introduction of the Microsoft Surface RT tablet ($699.00 direct), Microsoft also unveiled the latest in PC peripherals, the Surface cover and keyboard. While there will likely be third-party accessories coming soon, right now, Microsoft's own accessories are the only game in town. Like its sibling, the Microsoft Touch Cover, the Microsoft Type Cover is both tablet cover and keyboard, but it places far more emphasis upon the keyboard, with tactile keys, firm construction, and a look and feel that is far more like a traditional laptop than Microsoft's Surface ads have shown.

Design
Microsoft's Type Cover is both tablet cover and keyboard. In many respects, it's similar to the Logitech Ultrathin Keyboard Cover (for New iPad, iPad 2) , which both protects the tablet screen and offers a full keyboard for more productive use than the tablet alone could offer.

The Type Cover attaches to the Surface with a magnetic docking connection. The dock connects along the bottom edge of the Surface, attaching like the spine of a book, securely held in place by the magnetic connection. It's secure enough to pick up the tablet and let the cover hang loose without fear of the cover coming loose. When you don't need a keyboard, the cover folds back behind the tablet, which is sensed by an accelerometer in the cover, disabling the keyboard so that it can be gripped like a paper notebook with the cover folded back.

Unlike the Microsoft Touch Cover , which has no tactile feedback, the Type Cover offers a much more familiar feel, with scissor-switch keys, and a firm backing that makes typing on uneven surfaces a bit more feasible. The key-travel, though minimal, provides a much more comfortable typing experience. However, the introduction of key movement and mild key resistance means that typing is just a tad slower that on the Touch Cover, where you need only touch the key instead of depressing the key. The result is a keyboard that is more comfortable, but not quite as responsive. Whether or not that is an issue is entirely subjective, so head to a Microsoft Store if you want to try before you buy.

The Touch Cover is also slightly thicker, to provide the extra millimeter or so of key movement offered by the scissor-switch keys. As a result, the Type Cover is 6 millimeters thick, while the Touch Cover is only 3. The weight is also similar, coming in at 0.47 pound, just a whisper heavier than the 0.45 pound Touch Cover. Compared to Microsoft's other mobile Windows 8 keyboard, the Microsoft Wedge Mobile Keyboard , the Type Cover is much closer to full-size, making the experience much less cramped.

Compared to the touchpad on the Touch Cover, the Type Cover's touchpad is also a bit better, with a smoother surface. Like the Touch Cover, however, it still the miniscule proportions, measuring a tiny 2.6 by 1.4 inches. The mouse buttons are integrated into the touchpad and, like the Type Cover's keys, the right- and left-buttons actually click when pressed, providing a much more traditional mousing experience.

Features and Performance
Given that the Type Cover is made exclusively for Microsoft's Surface tablets, it should be no surprise that Windows 8 (and Windows RT) functionality is built in, with functions from the Charms Bar found in the F1-F12 buttons. These include volume controls, and Charms for Search, Connect, Devices, and Settings. You've also got function keys for Home, End, PgUp, PgDn, and the usual Esc and Del keys.

In actual use, the Type Cover certainly feels better than the Touch Cover, thanks to the moving keys and clickable mouse buttons, but compared to the Touch Cover, it's just not as sensitive, or as fast. On the other hand, it is more comfortable, and the typing fatigue experienced with the Touch Cover is alleviated by the cushioning springiness of the keys. For a Windows 8 keyboard with more sensible ergonomics, the Microsoft Sculpt Mobile Keyboard offers a curved surface with better typing feel. It's also going to be an easier transition for touch typists, as the keys are separate and distinct, with the usual nubs on the F and J keys to keep you anchored to the home row.

If you expect to do a lot of typing on the Surface RT, this is the keyboard to get. It's more comfortable and familiar than the Touch Cover, and is far more friendly to touch typists and users who may be away from a desk or table. It's not as cramped as the Microsoft Wedge, and it's more compatible with touch-typing than the Touch Cover. However, it's a little thicker, a little heavier, and it's not as responsive as the Touch Cover. The differences are minimal, but shoppers will want to get some actual hands on time with each before deciding which to buy.

Re: FTM 2 for MAC Sync Problems - Family Tree Maker software ...

I have the current version of FTM Mac 2. Tonight my file on my computer unlinked all children from their parents, sort of. If you go to a child, you will see the parents, but when you click on the parents, no children appear in the screen below even though the child still appears on the main screen pedigree chart.

I have used Family Tree Maker off and on for several years in both Windows and Mac and have always had various problems with the program corrupting files but this is a new one.

I'm very disappointed to see how horrible Family Tree Maker support still is after all these years and wish there were an alternative.

NBA: Clippers claim another victim

The Clippers smacked down another one Wednesday night.

They added the Miami Heat to their list of victims with a 107-100 victory at Staples Center, turning a close game into a runaway after Chris Paul took the game and made it his with a scoring binge late in the third quarter.

That would be the defending NBA champion Miami Heat, by the way.

The Clippers already knocked off the Memphis Grizzlies, Lakers and San Antonio Spurs before defeating the Heat.

Tougher tests are right around the corner, including a four-game trip after Saturday's home game against the Chicago Bulls.

After all, each of the Clippers' big four wins were at home.

Until they do it on the road, there will be questions about them.

Wednesday, the Heat's big three of LeBron James, Dwyane Wade and Chris Bosh were no match for Paul, Blake Griffin and the Clippers' superb second unit. The Clippers beat the Heat for the fifth consecutive game at Staples Center.

Paul drove a stake through the Heat's hearts late in the third quarter.

First, he swished a 3-pointer from near the `s' in Clippers lettering that extends across midcourt at Staples Center to beat the 24-second clock.

Officially, it

was from 32 feet away.

Paul swished another three on the Clippers' next possession.

Then he drove, turned in midair and nearly tossed the ball into the basket as he was fouled. He made both free throws. Then he got fouled again and sank two more free throws. Then he hit one more after Wade drew a technical foul.

By the end of the third quarter, the Clippers led the Heat 85-74 after Paul had scored 13 consecutive points, turning Staples Center electric. Paul had the fans on their feet and roaring, "CP3, CP3," in celebration.

The Clippers' backups extended the lead to 95-76 on a drive from Jamal Crawford, who created big problems for the Heat's second unit.

That's nothing new, though. The Clippers' reserves have run amok since the season began.

Crawford finished with a team-leading 22 points on 7-for-11 shooting in a reserve role for the Clippers (6-2). Griffin added 20 points and a team-leading 14 rebounds, Paul had 16 points and 10 assists and Caron Butler scored 15 points.

James scored 30 points for Miami (6-3), and Wade had only six points.

The Clippers and the Heat traded spectacular dunks and jaw-dropping moves around the basket almost from the start, but all of it was mere warmup for what Eric Bledsoe did to Wade early in the second quarter.

Wade ran ahead of the pack after the Heat pried the ball from the Clippers. He seemed destined for a crowd-pleasing dunk, when Bledsoe cut him off. Wade rose, but so did Bledsoe. Higher and higher, Bledsoe soared before swatting away Wade's shot.

A sellout crowd of 19,146 roared in appreciation.

It was the signature play in a half filled with great ones.

The Clippers led by as many as six points in a back-and-forth half. The Heat led by as many as five.

The Clippers led after the first quarter 25-24. The Heat led by halftime 54-52.

It was not flawless basketball, with the Clippers committing 13 turnovers in the opening half and the Heat compiling 11, but it was must-see TV. The best players for each team were their best players in the early going.

Griffin latched onto every rebound. Or so it seemed. He had eight by halftime.

James didn't score every time he had the ball, but he had 11 in the first half.

If there was an X-factor in the early going, it was Miami backup forward Rashard Lewis, who scored 11 points on 4-for-4 shooting.

Lewis made all three of his shots from beyond the 3-point arc, stretching the Clippers' defense to its limit.

The Clippers shot a scalding 62.5 percent (10 of 16) in the second quarter, but were outscored by the Heat 30-27 and trailed 54-52 by halftime because Miami made 5 of 9 from behind the arc and the Clippers also had eight turnovers in the period.

Mexico: Prospects for a New Foreign Policy

Foreign policy is not an area where one wants or expects to see a lot of fireworks, unless it is Venezuela, Russia, or Iran. ?And even then, it is often an unhelpful sideshow of insults, snubs, and hidden agendas. Mexico is a country that went from a mild version of fireworks, a position of isolationism, support for Latin America's left, and a reliance on international institutions during its 71-year period of one-party government?to become more open to trade, to question previous assumptions, and to become an active player in regional and international diplomacy. ?During the last decade and a half, the quality of leadership among public officials and career diplomats has arguably improved.

With regard to the United States, Mexico has gone from a prickly neighbor to trade partner to collaborator on law enforcement issues, and it now pretyt much punches at its own weight as a leader in regional affairs. ?So far, in statements and deeds, President-elect Enrique Pe?a Nieto shows no signs of abandoning this trajectory, reversing the country's position on trade, shrinking from global politics, or distancing Mexico from the United States. ?In sum, the prospects seem dim for a return to the past.

Will election results affect NASA funding?

The outcome of today's (Nov. 6) presidential election is unlikely to have a profound impact on the future direction of American spaceflight and exploration, experts say.

While Republican candidate Mitt Romney has revealed few details about his?space plans, a Romney Administration probably wouldn't dramatically alter the path NASA is currently pursuing under President Barack Obama, according to some observers.

"There are unlikely, as a result of the election, to be seismic changes," said space policy expert John Logsdon, a professor emeritus at George Washington University.

The status quo

In 2010, President Obama directed NASA to work toward getting astronauts to a near-Earth asteroid by 2025, then on to the vicinity of Mars by the mid-2030s. [Gallery: President Obama and NASA]

To reach these deep-space destinations, the agency is developing a huge rocket called the?Space Launch System?and a crew capsule called Orion. NASA hopes the SLS-Orion combo will begin launching astronauts by late 2021.

The Obama Administration has also encouraged NASA to hand over crew and cargo activities in low-Earth orbit (LEO) to private American companies. The aim is to fill the void left by the 2011 retirement of the?space shuttle program, which was set in motion by President George W. Bush back in 2004.

NASA has doled out a total of $1.4 billion in the past two years to firms developing crewed vehicles. The agency wants at least two crewed commercial spaceships to be up and running by 2017; until then, the United States will remain dependent on Russian Soyuz spacecraft to provide this orbital taxi service.

The progress has been faster on the cargo front, with California-based SpaceX completing the first of 12 contracted supply flights to the International Space Station with its?robotic Dragon capsule?last month. NASA has also inked a resupply deal with Virginia-based Orbital Sciences Corp., which aims to launch a demonstration mission to the orbiting lab in the coming months.

Sometimes I feel like I spend a lot of time writing about the things people do that are incorrect in EDiscovery, but I realize that there is more information out there about what people do that is wrong than what is right.? It is generally not a story that most people follow the law and the rules of evidence, but it can be instructive to everyone when we highlight an error in judgment in an attempt to make it a learning moment.? And sometimes, the fact that someone has suffered some type of damage as a result of their action makes people pay attention to the issue.? Figuring out that the opposition has willfully withheld discoverable evidence is becoming an important part of obtaining ESI in today?s world.? No one wants to suffer a sanction that costs them or their client money.?

This week?s posting is about this type of action, but it has a twist based on the FRCP 37.
Generally, news about EDiscovery focuses on whether a court should approve a particular order to compel discovery in a case based on a set of circumstances.? The resolution of this request is usually the end of the argument and parties move into the discovery phase based on the court?s order.? In Multifeeder Tech, Inc. V. British Confectionery Co. Ltd. 2012 WL 4135848 (D. Minn. Sept. 18, 2012), the usual discovery issues have a different twist.

The Rule
Federal Rule of Civil Procedure (FRCP) 37 was written to outline the process of disclosure of discovery material and contains very detailed steps about the ramifications of failing to comply with the requirements (i.e., the order of the court).? Under FRCP 37, if a party fails to comply with an order to provide or permit discovery to move forward, the court may then issue further orders including: 1) holding the violator in contempt of court and 2) ordering the violator, the attorney advising the violator, or both to pay the reasonable expenses, including attorney?s fees, that were incurred as a result of failing to comply with the order.?

The Case
The real story of this case, which involves a breach of contract, started in 2010, when the plaintiff moved to compel discovery regarding a number of very specific document requests which were granted by the court.? Usually, that is the end of the discovery dispute and the party complies with the judicial ruling.? Six months later, the plaintiff submitted further motions to the court requesting sanctions due to the defendant?s failure to comply with the order of the court.

The magistrate judge overseeing the case granted the defendant?s order for sanctions, but stayed the sanction, in an attempt to get the parties to cooperate and come to an agreement about the EDiscovery.? If the parties could not reach agreement, then each side would submit individual proposals that the court would use to create a protocol.? When the parties could not reach a mutual agreement, the court selected the plaintiff?s proposal and appointed a computer forensic expert to search and image the defendant?s computers, with costs allocated between the two parties.

The forensic examiner presented its findings to the court, including the following three major observations:

??Commercial wiping software programs were found on key custodian?s computers
??At least six incidents of deletions occurred after the discovery protocol was ordered by the court
??Encrypted data was found on a vice presidents laptop computer that had not been revealed by the individual and was therefore considered wrongfully concealed.?

The Findings
As a result of these findings, the magistrate judge recommended that the defendant be held in contempt and required to pay $500,000 in monetary sanctions.? Part of those sanctions was to cover the forensic examiners fees.? Additionally, there would an adverse inference instruction at trial. Neither party was satisfied with the ruling and objected.? On appeal, the district court accepted the magistrate judge?s recommendations, but increased the monetary sanctions imposed on the defendant from $500,000 to $625,000.

The district court justified its ruling based on two primary reasons, both based on FRCP 37:


??Under the Rule, the plaintiff was due reasonable expenses caused by the defendant?s failure to comply with the original court e-discovery order. Those costs included ?reasonable legal fees and expenses in litigating this discovery dispute? and unpaid invoices from the appointed computer forensic expert.
???Rule 37 sanctions should be crafted to both punish and deter.? Since the plaintiff had suffered what the court considered extensive prejudice based on defendant?s actions, and that the prejudice was based on the non- compliance with the original court order, the sanctions could and should be imposed.

The Takeaway
With the advent of sophisticated technological tools to find and identify instances of intentional deletion or obfuscation of computer generated files, corporations and their attorneys are undergoing increased risks when they try and make information disappear or attempt to hide information from the opposition.? Parties who believe that the ESI being discovered is insufficient or suspicious should avail themselves of the forensic expertise required to obtain the information that is discoverable and provide the courts with proof of sanctionable behavior.? Forensic examination of computers will often identify behavior and missing documents that are very difficult to justify to a judge and should be a part of every litigator?s tool box.

While it can be difficult to determine that there are gaps in discovery that should be filled and request specific documents be produced, there are tools on the market that can help a firm proactively examine the existing information and identify logical gaps (the missing ESI.? Applying advanced data analytics tools to ESI can help identify potential gaps in information.? One of the strongest tools in this area is semantic language search technology.? It seeks to improve search accuracy by understanding the intent of the searcher and the contextual meaning of terms as they appear in a searchable text.? Semantic search processes consider multiple points of information simultaneously; including context of search, location, intent, word variation, synonyms, generalized and specialized queries, concept matching and translation of natural language queries to provide a result set of documents.? In summary, semantic search lets you query the underlying meaning of the document and therefore identify obvious missing information.
